Abstract

The State’s role in guaranteeing ecological balance as per the Brazilian Constitution (1988) incites a discussion about environmental policies in Brazil. In this context, the present piece examines the effects of excessively flexible environmental laws, which may harm whatever has been established so far. What path will the Brazilian Government follow for environment protection? Will it build stronger or weaker green regulations? The study of the State (within Political Philosophy) has aided in answering those questions. Besides the aforementioned subjects, this paper also regards Neo-extractivism, a new set of practices followed by some Governments in Latin America, including Brazil. Ultimately, the method consisted of literature review and documental analysis that included laws, bills, and deliberations linked to the failure of environmental protection in Brazil. In conclusion, this research uncovered the State’s incompetent efforts towards environmental compliance.
