CONDIÇÃO FEMININA E CASAMENTO A PARTIR DA OBRA DE MARIANNE WEBER

Abstract

Resumo

Este artigo apresenta a primeira síntese de uma investigação em curso cujo objeto é o legado intelectual de Marianne Weber (1870-1954). Em "Ideia e forma", fazemos uma análise dos conceitos por ela adotados em seu livro Ehefrau und Mutter in der Rechtsentwicklung ("Esposa e mãe no desenvolvimento do direito"). Em "Ser-humano e ser-mulher" buscamos articular o argumento de Marianne sobre o direito ao casamento civil com os termos do debate atual a respeito, a partir de uma perspectiva feminista liberal.

Abstract

This essay presents a first synthesis of an ongoing investigation whose subject is the intellectual legacy of Marianne Weber (1870-1954). In "Idea and Form", we analyse of the concepts adopted by Marianne in her book Ehefrau Mutter und in der Rechtsentwicklung ("Wife and mother in the development of law"). In "Human being and Woman-being" we try to articulate, from a liberal feminist perspective, Marianne's argument on the right to civil marriage with the debates about this question in the last years.
