A PRELIMINARY APPROACH TO THE STRUCTURE OF ENVIRONMENTAL LEGISLATION AND BRAZILIAN ENVIRONMENTAL MANAGEMENT AND ITS APPLICATION IN MUNICIPALITIES:
the case of Ituiutaba - MG

The environment has been the subject of great discussions over the years and within the various issues that encompass the environment, there is environmental management, responsible for addressing public policies in its debates. However, the praxis when talking about environmental management and environmental legislation in an approach focused on sustainability, is out of place or does not seem to complement what was foreseen by the current Brazilian laws, thus generating several conflicts between the different social actors. Thus, the main objective of the present work was to know the environmental management of Ituiutaba / MG from the municipal environmental legislation in force. For the development of the work it was necessary to carry out surveys of the updated bibliographies existing on the theme. In addition, it was sought, within the current Brazilian legislation, to build a scenario of how to regulate issues related to the environment at national level until reaching the municipal scenario. For this, it was used the websites of the Ituiutaba City Hall and the database of the IBGE MUNIC (Brazilian Institute of Geography and Statistics / Research of Basic Municipal Information). As a result, it can be understood that the scale of the municipality is the place where the State is closest to society and, also, where everything materializes in the territory, and the difficulties in dealing with issues related to the environment become a great challenge. It was observed in the municipality of Ituiutaba-MG the difficulties to form an environmental management system that contributes to the elaboration of a consistent legislation that resists the administrative and legislative mandates. However, it was observed that it is important that the municipalities treat the environment in an integrated manner, creating their Municipal Environment Policy and their Municipal Environment System, which are articulated with SISNAMA.
