Abstract

The present study has as objective analyze actions of the Judicial Power ensure access to Intensive Care Unit during COVID-19 pandemic, aiming at the realization of the right to health. In short, this work intends to carry out the historical rescue of the right to health in Brazil,which ocasion in the provision in the Federal Constitution of 1988 as a social right, the right of the entire population and duty of the State as well as analysis of the judicialization of health in Brazil. For this purpose, in addition to bibliographical research, will be conducted a study of the decisions in the Court of Justice of Rio Grande do Sul in COVID-19 pandemic about demands for obtaining Intensive Care Unit for patients affected by the disease, in order to identify to what extent the judiciary managed to guarantee, or not, the right to health.

Doutoranda em Direito Público pela Universidade do Vale do Rio dos Sinos- Unisinos. Pesquisadora. Membro do Núcleo de Pesquisa em Direitos Humanos da Unisinos. Mestre em Direito pela Universidade Regional Integrada do Alto Uruguai e das Missões (URI); Bacharel em Direito e pós-graduada em Direito Ambiental pela Universidade Regional do Noroeste do Estado do Rio Grande do Sul (Unijuí). Atualmente é professora e membro do Comitê de Educação para os Direitos Humanos no Centro Universitário Cenecista de Osório - UNICNEC.
