Abstract: The article addresses the gathering of digital data locate abroad (devices and in the clouds) for criminal matters. The article focusses on international judicial cooperation and jurisdiction to execute as different mechanisms to obtain the evidence located in the territory of other States, taking into consideration the impacts not only on the interesses of the but also the human rights of the individuals involved.
