Abstract

This article presents a study on the Constitutional Amendment no. 95/2016 in light of the theory of constitutional dismemberment created by Richard Albert. To do so, it makes a recovery of the debates of Comparative Constitutional Law on the theory of unconstitutional constitutional amendments. The purpose here is to demonstrate that Constitutional Amendment no. 95/2016 constitutes a hypothesis of dismemberment of social rights. The methodology applied makes a critical use of the theoretical references that work on unconstitutional constitutional amendments in Comparative Constitutional Law.
