Abstract

In order to analyze the changes introduced by Law nº 12,015 / 09, specifically in relation to the offense of rape, this research discusses the possibility of abortion on demand in the event of man appear as the subject offense liabilities. The main purpose of the law was to ensure greater effectiveness and protection in applying the principle of human dignity against violation of the sexual intimacy of the human being, so as to respect the dignity of all sexual. Therefore, considering the amendments on the crime of rape, we analyzed the active subject of the figures and liabilities, with a look at the participation of women as the perpetrator of criminal mode. Thus, by means of legal research legal-dogmatic aspect of deductive reasoning interdisciplinary by hermeneutic or interpretive research, used the theoretical or literature method, it was the possibilities for restrictions of the fundamental right to life of the unborn, specifically in regard to abortion request made by man, by which we used weighting theory of Robert Alex principles before the collision interests of third parties against the case to support the legitimacy of the intervention. ervenção.
