The interlocutory judgment of non-admission of prosecution which is given by the judge in case of crimes that should be decided by a Jury proceedings is not according to the 1988 Federal Constitution and, besides that, it is still untouched in our legal law system after the changes carried out by the Law n. 11.689/08, in clear conflict with the present constitutional principles.
