Abstract

As the human society, the law is a dynamic phenomenon, not static, which must be studied and interpreted from its general theory. In the past, the so called 'Right of Citizenship' was conceived as privileged 'status'. In modern times, the so called ‘Right of the Citizen', was re-designed as a political right. Currently, the re-named 'Right of Citizenship', restrictedly returned to political rights, including civilians, as individuals. According to the Citizen Conception, the now called Right of the Citizenship, as well as the duties, rights, classified as civil rights, political rights and social rights of each and every one at the same time as a citizen, as constitutionally established therefore classified as public diffuse right.
