Based on the analysis of the laws elaborated by Jacob Gorender to describe the functioning of colonial slavery as a historically new mode of production, we argue in this paper that the determination of the value of the enslaved labour power, namely, of the necessary labour time for his sustenance, arises as an empirical problem for the owner. We also indicate how the specific formation of a relative overpopulation in the Brazilian economy consolidates a lowered level of wages in the transition from slavery to wage-earning.
