This work is developed with the normative system of copyright as its thematic area, investigating a specific problem regarding the incidence of these rights in academic guidance processes. The general objective of the research is to identify whether mentoring professors have co-ownership of rights over the works published by their mentors. And for this, specific objectives were considered to analyze the legal guidelines on
the incidence of copyright and on their ownership, in addition to analyzing the regimental provisions and the doctrinal positions on such topics.
Carrying out a concrete situation study and literature review to identify if there is provision in regulations, legislation, doctrine and jurisprudence on the topics addressed, we seek to answer the central question. With its
development, the research identified that there is no ownership of rights reserved for teachers who develop guidance tasks, as they do not meet legal requirements that justify co-ownership. The aim is to collaborate with legal and ethical issues involving this problem.
