In this commentary, it was intended to study the proposals to amend articles 164 and 165 of the State Constitution of Paraíba, through Representation 1.048-1/PB, in conflict with the prohibition against the setback in environmental protection. The articles under review aimed to discipline and restrict the construction of buildings in the Municipalities of Cabedelo, Campina Grande and João Pessoa, with the purpose of guaranteeing the correct urban planning and promoting the quality of life of the community. As expected, such legislation was contrary to the interests of the civil construction market. From this dispute, Representation 1.048-1/PB arose, which was dismissed by the Supreme Court. It was observed that this ruling can be considered as a milestone in the construction of the Fundamental Right to the Ecologically Balanced Environment, reinforcing the importance of cultural heritage and bringing reflections, even in the Federal Constitution of 1988 and clearly marked the prohibition to the regression in Law Environmental.
