The Fulfillment of Sentences by Eldery people in times of pandemic

This research discusses the reality of the incarcerated elderly population, regarding their constitutional rights that guarantee human dignity, internal and external normative diplomas of protection; the condition of the prisoner in this age group within the penitentiary system and the meaning of this aging process. It aims to investigate the conditions of Brazilian prisons to house a group of elderly people and whether the protective rules for the elderly can be applied in prisons, especially during the COVID-19 pandemic. For the development of this research, an inductive approach was used in a scenario with few demographic censuses, qualitatively elaborating a descriptive literature review from primary and secondary sources, based on the monographic technique. As a result, this study showed that, despite the aging of the Brazilian population being notorious, there is still not the necessary concern regarding this age group within prison establishments. There is a lack of public policies for the prevention, maintenance and rehabilitation of groups. Furthermore, it was concluded that there is a need for further studies on the subject, with an interdisciplinary and egalitarian view, especially at this time of pandemic, where various rights of the elderly are being disrespected.
