Abstract

The spread of SARS-CoV-2 caused the limitation of certain fundamental rights as a measure to protect the right to health and life. However, many of these measures were applied in a diffuse manner, causing confusion about the respect of fundamental rights such as the right to assembly and group. Therefore, by means of the deductive method, this document seeks to study the measures adopted by Spain regarding the infringement of the right to freedom of assembly and group. In the end, it concludes in the application of the diffuse horizontality of the rights to assembly and association in contrast to the right to health and public order, being questioned in relation to the sentences and pronouncements by the Constitutional Courts.
