Abstract

The Democratic Rule of Law is essential for guaranteeing and enforcing human rights at the state level, in the form of fundamental rights. Ratification of human rights treaties by states is also possible only when there is democracy. In this sense, using the method of deductive approach and the technique of bibliographic research, this work seeks to demonstrate that human rights are consolidated and are only guaranteed when there is a Democratic Rule of Law, but it is still possible for a violation of these. Rights by states and  Conventionality control may be the way to pursue the realization of these rights outside the jurisdiction of the State.
