Abstract

This is a case law commentary on Special Appeal n. 1.788.601/SP, which addresses the issue of international abduction of children, in which the limits between the 1980 Hague Convention and the principle of the best interest of the child are discussed. In this analysis, it is concluded that prudence in cases related to the return of minors is the most appropriate position, as it embraces the aforementioned principle, even if this means a delay in the return of the minor.
