Abstract

The new legal interests are actual in the pos-modern society. Due to that the study of penal protection ways as ultima ratio deserves attention. In that context some penal institutes named danger crimes, white penal norm and open crimes are introduced. The claim for efectivity in the penal protection reaches, as well, the procedural penal process, which should leave back the indisputable evidence and assume the circumstancial evidences, that are considered by probability judgments, based on previous scientific studies, all of that my influence the judge in his convincing.
