Abstract

The presente issue analyse the judge function for the material equality and the dignity labor by the juridic sistem inside of the economic, capitalist and global order. For this, by bibliografic ressearch and dedutive method confirm the guarantee of labor law dignified by the interpretation of the work contract by the protective vision, on the possibilities to apply the equality principle. The judge's interpretation must to considerate a system of the action principle, inside of evaluative coherence, with pluralism of the interpretatives methods and having the right as a social practical for the Justice materialize.
