Abstract

Dogmatic is presented as a set of argumentative assumptions indispensable for the development of knowledge, which the subsequent developments can not deny. Applied to the science of law, this concept provides a coherent system of propositions, institutionally organized and legislative content, built to resolve
practical issues. From that argumentative coherence in the field of criminal law, different theoretical schools succeeded, focusing, each of them, to various social problems and realities. The positivism, the neokantism, the finalism and funcionalism were structured in firm supports and earn more sense when understood historically.
