Abstract

The paper is about the doutrinary and political aspects of the eletronic devices of fiscalization in penal processo or penal execution. This devices control the movements of the accused or the condemned by instruments linked in the body of the person. The paper discuss the juridic nature of the electronic fiscalization and its adoption as a penalty or as an assecuratory instrument of processual guarantee, and the consequences of choosing each option. The subject is important because the approval imminence of a law project about the electronic fiscalization.
