Abstract

This article intends to analyze and present a critical thinking about the basis of the Conglobant Vagueness
Theory. There are not many writings on the subject, which, while difficult the obtaining of specific works, one the other side allows a full and open discussion with regard to its assertions. It is tried, therefore, to understand the structure of the elements of the theory of the criminal offense in accordance with the thought of EUGENIO RAÚL ZAFFARONI. Moreover, brings up a comparison with other forms of thinking the conceptual development of criminal offense theory, always aiming to improve the tools at disposal of the criminal-legal dogmatic in the resolution of concrete cases. More than conclusions, questions and occasional postulations are made in order to disseminate the theory and, at the same time, criticize it and academically enjoy what it has that fits and is most appropriate to our contemporary criminal reality.
