O Controle de Constitucionalidade de Normas Municipais

Abstract

The Brazilian State presents a complex federative form when recognizing as beings of the federacy the Union, the State-members, the Cities and the Federal District, in view of that, all these federal entities inside of its autonomy politics will be able to elaborate basic norms of organization, as the State Constitutions, the District Organic Law and the Municipal Organic Laws, beyond the production of laws and state, district and municipal acts normative. This extensive normative system determines the existence of a complex model of constitutionality control. In the present work we will go to establish the possibility and the hypotheses of if exerting constitutionality control on the Municipal Organic Laws and the municipal normative acts, being overcome for base the paradigms or parameters of constitutionality the Federal Constitution and the State Constitution, beyond the possibility of the control of constitutionality of the municipal normative acts in face of the Municipal Organic Law.
