Abstract

The concepts of judicialization of politics and judicial activism, although are find in several works in judicial
and political-scientific literature, not rare are used in a discretionary way, under which it is not possible to derive a true signification and, principally, a differentiation. In this sense, the present work takes the study of such phenomena, identifying, in that way, a theoretical concept of judicialization of politics and judicial activism, as well as the kinds of ways they show up. In this study we can find, besides, a practical application of such a theoretical plan, making a true exercise of analysis of the vision used  y the Ministers of the STF, as well as the ramifications of these interpretations in their votes. Working with a diversity of activisms, allow, besides, the observation that the phenomenon of judicial activism does not curtail to only a static way which the judge appears too political, but, on the contrary, that the political character can be identified as conservative itself.
