Abstract

This work is in discussion of the legitimacy of the expansion of criminal law in the protection of coletives legal goods, specifically the environment. There are the political-criminal reasons, based on the risk model of society, who turn to the assertion that the criminal law should protect the environment but, due to its crucial to the existence of life of present and future generations, and that the legaldogmatic criminal should focus on the prevention of environmental damage, updating their categories of allocation so as to anticipate the action by the punitive action through the technique of crimes of abstract danger and ancillary administrative.
