Abstract

The present study has as objective analyze actions of the Judicial Power ensure access to Intensive Care Unit during COVID-19 pandemic, aiming at the realization of the right to health. In short, this work intends to carry out the historical rescue of the right to health in Brazil,which ocasion in the provision in the Federal Constitution of 1988 as a social right, the right of the entire population and duty of the State as well as analysis of the judicialization of health in Brazil. For this purpose, in addition to bibliographical research, will be conducted a study of the decisions in the Court of Justice of Rio Grande do Sul in COVID-19 pandemic about demands for obtaining Intensive Care Unit for patients affected by the disease, in order to identify to what extent the judiciary managed to guarantee, or not, the right to health.
