The objective of this article is to research how the use of pesticides in agriculture influences public health, discussing the concept of pesticides, their use in Brazil, their harm to human health, the constitutional right to health and how the Brazilian State has acted in order to guarantee the preservation of such right to citizens. After all the research, it was found that Brazil has alarming numbers when it comes to the use of such chemical agents, being responsible for consuming 20% of all pesticides produced in the world. The research is even more frightening when it comes to the harm that pesticides can cause to health, ranging from simple symptoms to chronic diseases such as cancer. It was found that Brazil has extremely soft legislation compared to countries in the European Union when it comes to restricting its use and, after analyzing the fundamental right to health provided for the 1988 Constitution, it was concluded that the State's omission regarding the control of pesticides can be considered unconstitutional.
