Introductory Notes for a Approximative Reading

Abstract

In this article, we analyze the response of democratic constitutionalism to the relationship between constitutionalism and democracy. Far from the intention to solve this “puzzle”, we seek to understand the fundamental features of this theory and the possibilities of comparative reading between the practices of the American and Brazilian constitutional jurisdiction. We used the literature review methodology to make the comparison. The results found justify the comparative effort, despite the difficulties of a Brazilian backlash there is a movement in progress.
