Judicial precedent as a tool to combat decision-making standardization in the new Civil Procedure Code

This work aims to analyze a decisive standardization in Brazil through a comparison between the main legal systems, which are the common law and civil law systems. The study will be divided in three parts, the first is the study of the two main legal systems, which are the common laws and civil law, there, will be a comparison of the Brazilian legal system with the common law, for, finally, analyze a question of adoption of precedents by the Brazilian’s judiciary. Thus, the study goes through systems analysis, to then demonstrate the phenomenon of commonlization the civil law that occurs in Brazilian’s law. In the sequence, a differentiation will be made between jurisprudence and precedent, as well as a study on the adoption of a reconstructive path of the current Brazilian’s legal system, whose objective is unity in law and respect the constitutional principles of legal security, freedom and use in the field of Brazilian’s Code of Civil Procedure.
