Recognition of the Active Participation of the Victim in the Criminal Process in the Light of Human Rights

Currently, some classical notions of criminal and criminal procedural law have begun to be rethougth. Certain key concepts have entered into crisis. One of the main topics of great debate turns out to be the evolution towards a greater participation of the victim in the criminal process. This led to the generation of certain tension points or possible collisions between the constitutional guarantees of the different subjects
involved. Therefore, in the development of this work we will analyze the link between the victim´s participation in the criminal process and its eventual impact on the rights of the accused. To do this, in a briek way, we will make reference to certain nuclear aspects of this issue, and we will highlight pronouncements that we consider relevant issued by the Inter-American Court of Human Rights and the European Court of Human Rights. Finally, we will present out conclusions.
