Discrimination and Price Diferentiation in Consumer Relations

The present work distinguishes the differentiation of prices from discrimination of consumers. Based on this distinction, it discusses the possibilities and legal prohibitions of consumer price differentiation for the same item in Brazil. The first part presents the legislative innovations related to the differentiation of consumer prices according to the modality of payment to be adopted. It also analyses some practices of price differentiation prohibited by law. From the analysis of provisions of the Constitution of the Republic, the Consumer Defense Code and current legislation, the need for and relevance to the prohibition of discrimination against consumers is demonstrated.
