Abstract

The author gains a brief historical insight into brazilian juridical system to show the great influence of private law on its development. He calls our attention to the existence of mistakes, incongruities and anachronisms when enforcing the law, and analyses the evolution of brazilian civil legislation. Finally, he then conclude that in spite of the progresses of judicial techniques, the formation of a jurist’s character and the production of juridical technical writings of the country are still dissociated from social problems and reality, being influenced by juridical archaisms own to an individualistic and agrarian society.
