Abstract

Objective the present study to discourse regarding the Courts Special State Civil court jurisdiction as instrument of social pacification. The fático bedding of this quarrel is the scene that comes if forming in Brazil throughout the last decades: exponential growth of the population and consequently an increase of the search for the Judiciary Power for the clearing up of its you deal, what “Crisis of the Judiciary System” culminated with the call. Of this form, as much the proper one To be able Judiciary, how much the Legislative, comes if pledging to solve the question, mainly to guarantee to the Brazilian citizen a greater and cash access to justice. Thus, in this conjuncture it is that the State Special Courts had been created, foreseen originarily in the Federal Constitution of 1988 (art. 98, incorporation I), structure which, as already said, is object of this present study. Finally, analysis on the access to justice and the evolution will be made history and doctrinaire concerning the search for the effectiveness of the process, culminating with the study of the legislation and principles of the Courts Special State Civil court jurisdiction, as instrument of social pacification.
