The law # 11.232/2005 abolished the autonomous lawsuit of sentence’s execution with the reform of the execution of right amount. The condemnation to the payment of right amount won’t depend of the actio iudicato in new procedural relation. The execution of victual’s pension is execution of right amount. However, the law # 11.232/2005 didn’t alter expressly the article # 732 of Brazilian Civil Procedural Code. For this reason, discussions appeared regarding the introduction of law # 11.232/2005’s dispositions in the execution of victual’s pension. This work will defend that to dispositions of the law # 11.232/2005 change the victual’s execution willing in the article 732, because of right and social reasons.
