Law 9,605/98, which deals with environmental crimes, innovated when it provided for the criminal liability of legal persons engaging in crimes against the environment. Ten years past its coming into force, this paper studies the legal framework and circumstances leading to its enactment, as well as pro and con arguments and jurisprudence on the subject. It concludes that today, despite the fact that contrary positions subsist, dominant doctrine and jurisprudence accept the indirect responsibility of the legal person, linking it to its legal body or representative.
