Abstract

The present scientific article aims at to analyze the question of the decriminalization of the behavior of the narcotic substance use, to the light of the Law n.º 11,343/06, which modified the penalty applied to the species, to the warning for the judge to the user on the risks of use of prohibit substances. Thus, one notices that the educative aspect of the new law generated one stir in the legal world, being that, for part of the doctrine the new criminal type would have decriminalized the behavior and for another part of the same one it only modified the type of applicable penalty, not decriminalizing the behavior. Therefore, in the present article it will analyze the legal aspects of the question, aiming at to conclude if it had or not it decriminalization of the behavior of the narcotic substance use.
