Understanding gender in the Rome Statute

Abstract

The lack of legislation that deals with the rights of LGBTQIA+ people represent a major social  problem and a violation of human rights, so it is necessary to analyze the understanding of gender by the Rome Statute, with the scope of  understanding which guarantees are violated and how violations could be prosecuted at the  international level. This research aims to verify the need of expanding the concept of gender  provided for in the Rome Statute from a queer hermeneutics. Bibliographical research was carried out through the studies of the doctrinaires of international legal study; of laws and concepts that deal with the subject; with data analysis 
under the hermeneutics of queer theories.
