Abstract

This article discusses the problem of the technic of the criminal law in white and its use in a criminal law guided by the Sociology of Risk. First, are discussed specific aspects relating to criminal laws in white, like the concept, origin and classification, and too the justification for your use (1). Secondly, it is analyzed the called Criminal Law of Risk, as a product resulting from the influence of modern sociology of risk on the criminal law (2). Finally, are analyzed the specific constitutional aspects that prevent the adherence to a Criminal Law of Risk and, consequently, the abusive use of criminal laws in white.
