A construção da verdade jurídica no processo inquisitorial do Santo Ofício português, à luz de seus regimentos

Resumo

A análise dos Regimentos do Santo Ofício português revela lógicas de justiça e estratégias desenvolvidas institucionalmente, ao longo de seus quase trezentos anos, com o objetivo de definir a fórmula processual para se chegar à verdade de suas sentenças, verdade que pudesse ser considerada juridicamente válida, suficiente para legitimar as atividades do Tribunal. Neste artigo, procuraremos entender o caminho que, segundo os manuais e regimentos da Inquisição portuguesa, deveria ser seguido para se chegar à verdade que interessava àquele tribunal.

ABSTRACT: The analysis of the Regiments of the Portuguese Santo Ofício reveals justice logics and developed strategies institutionally, throughout its almost three hundred years of existence, with the purpose of defining the procedural formula to arrive to the truth of its sentences, truth that could be considered juridically valid, sufficient to justify the Tribunal activities. In this article, we will seek to understand the path that, according to the manuals and regiments of the Portuguese Inquisition, should be followed in order to reach the truth that mattered to that tribunal.
