Abstract

Taking up by the basic principle of social retrocession’s prohibition, implicitly had in town-with Brazilian and the notion of humanism devoted which must reign interpersonal relations, this text seeks to address the key  problem as the judicial decisions that, in applying the law, give him a humanist interpretation, the inda-that it does not glimpse the social function and human dignity instantly.
